Appellate Overload?

Catch my guest opinion in the Las Vegas Business Press here.  The LV Business Press has kindly offered to published my scribbles the first week of each month.

Meanwhile, after a busy August, I am hoping to catch up on the Ninth Circuit's opinions over the next few days.

Nevada has grown so much since I left in 1978, I am surprised you still do not have an intermediate appellate court. From what I gather from your article, the Supremes have no discretion to select cases for review and must review EVERY appeal? Yikes.

Believe it or not, to be heard by the California Supreme Court you must petition for review (somewhat like a cert petition to SCOTUS), and the Supremes only hear about 1 in 40 cases (perhaps as many as 1 in 25 in a big year).

Certainly, your Supremes deserve a break! An intermediate appellate court is a good start, but I don't think the Supremes' workload is going to decrease greatly until their review is discretionary.
