Pending Changes in Nevada Rules of Appellate Procedure

The Supreme Court of Nevada has approved several changes to the Nevada Rules of Appellate Procedure.  The amendments affect Rules 3C, 3E, 9, 10, 28, 28A and 30. The Rules changes are effective July 1, 2007.  The changes primarily relate to inclusion of transcripts in the appendix of the excerpts of the record on appeal.

The substatntive changes to Rules 3C and 3E, relating to fast track criminal and child custody appeals respectively, delete the requirement that the court reporter deliver copies of the rough draft of the trial transcripts to the Supreme Court Clerk, but require the reporter to inform the Supreme Court Clerk of the date the transcripts were provided to the requesting party. Relevant transcript excerpt will needed to be included in the appendix.

The substatntive change to Rule 9 requires the court reporter to inform the Supreme Court Clerk when transcripts have been delivered to the requesting party.

The substatntive change to Rule 10 requires the Appendix to include all transcripts necessary fort he Supreme Court's review.

The substatntive change  to Rule 28 requires that factual citations be made to the relevant pge in the appendix containing the transcripts or excerpts of hte transcripts.

The substatntive change  to Rule 28A requires the attorney to certify that factual assertions have been supported by reference to relevant appendix pages. 

The substatntive change to Rule 30 requires that the appendix include all transcritps necessary for court review.
